Kurita America Inc. (“Kurita America”, “we”, “us” or “our”) respects the privacy of our customers and website visitors (referred to as “you” or “your”). This data privacy policy (and as amended from time to time as posted on our website here) (“Privacy Policy”) describes the types of information we collect from you or that you may provide when you visit or use our www.kuritaamerica.com website or use our services and our practices for collecting, using, maintaining, protecting, disclosing, retaining, and transferring that information. This Privacy Policy applies to the data collected by us or those working on our behalf through information you enter or from the data imported from authorized and approved sources. This Privacy Policy does not apply where a separate privacy notice is provided, including certain employment-related or other context-specific notices.

By using our website or by using our services, you acknowledge that we may process your personal information as described in this Privacy Policy. Where required by applicable law, we will obtain your consent before processing personal information for specific purposes, such as certain sensitive data uses or certain non-essential cookies and similar technologies. Your privacy rights may vary depending on where you live.

This Privacy Policy applies to “personal information” or “personal data,” meaning information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household, subject to applicable legal exceptions. It does not include deidentified information, anonymous information, or publicly available information where excluded by applicable law.

Individuals Under the Age of 18

We do not knowingly collect, solicit, or maintain personal information from anyone under the age of 18 or knowingly allow such persons to register for our services. If you are under 18, please do not send any personal information about yourself (such as your name, address, telephone number, or email address) to us. If we learn that we have collected personal information from a child under the age of 18 without verification of parental consent, we will use commercially reasonable efforts to delete that information from our database. Changes to Our Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and revise the “Last Updated” date. If required by law, we will provide additional notice or obtain consent for material changes.

Payment Information

When you make a purchase, payment information, such as your credit card number, debit card number, expiration date, CVV, billing address, and related transaction details, may be collected and processed by us and/or our third-party payment processors to process your transaction, authenticate payment, prevent fraud, process refunds or chargebacks, and comply with legal, tax, accounting, and security obligations. We do not use payment-card information for unrelated marketing purposes. We use a third-party payment processor and only receive limited payment-related information, such as transaction confirmation, payment token, card type, last four digits of the payment card, billing information, and transaction identifiers.

Business and Operational Data

We collect certain business and operational data from our customers in connection with the products and services we provide.
This data generally falls into three categories:

• Enterprise Resource Planning (ERP) Data. We collect data generated through day-to-day business transactions, including invoices, purchase orders, and related records used to support standard business practices such as order fulfillment.

• Internet of Things (IoT) Data. We collect data from sensors and devices connected to equipment at customer sites. This data is used for (a) diagnostic analysis, including real-time monitoring; (b) monitoring equipment health and alerting customers of issues, such as deviations in water parameters; (c) descriptive analysis, including historical reporting; and (d) dashboard visualizations that provide customers with trends and patterns related to their operations.

• CRM Data. We collect and store information about business contacts and sales leads in our CRM system. This includes information entered by our sales representatives and information submitted directly by prospective customers, such as through website forms requesting product or service information. The information is maintained to support sales activities, customer engagement, and the management of ongoing business relationships.

The personal information we collect and store in connection with ERP, IoT, and CRM data may include business contact information (such as name, job title, and business name and address), payment information (such as credit card or bank account details) necessary to process transactions, and any other information voluntarily provided to and/or recorded by our sales representatives in connection with the business activities described above.

From What Sources Do We Collect Personal Information?

We collect personal information

• directly from you, such as when you submit forms, contact us, register for events, subscribe to updates, make inquiries, or apply for a job;
• automatically from your browser or device when you use our website;
• from IoT sensors and devices connected to customer equipment, which collect operational and diagnostic data;
• from service providers that support our website, analytics, communications, recruiting, event management, and security functions;
• from business partners, marketing partners, publicly available sources, or other third parties, where permitted by law; and
• from recruiters, references, background-check providers, or publicly available sources in connection with employment applications, where permitted by law.

If you submit information regarding employment via our career website portal, we may obtain information from third parties about employment as part of a background check, among other information, as part of the application process. 

Careers and Applicants

Our “Careers Website” (available here) has information about employment opportunities with us. If you apply for a position with us, we and our recruiting vendors may collect application materials and related information, including employment and education history, qualifications, references, and background-check information where permitted by law. We will provide an additional applicant privacy notice where required.

Information We Collect Through Automatic Data Collection Technologies

When you use our website, we and our service providers may automatically collect information about your device, browser, network connection, browsing activity, referring pages, pages viewed, links clicked, approximate location derived from IP address, and similar usage information. Depending on the technologies used and applicable law, this information may constitute personal information.

We use this information to operate our website, secure our systems, understand website usage, improve functionality, measure the effectiveness of content and campaigns, and, where permitted, support analytics and advertising. We may use cookies, pixels, analytics tools, and similar technologies to understand how users interact with our website and, where permitted, to support advertising, campaign measurement, and audience development. Depending on applicable law, these activities may constitute “targeted advertising,” “sharing,” or similar regulated processing.

Cookie Notice/Policy

The technologies we use for this automatic data collection may include cookies, local storage cookies, web beacons, and pixels; each of these is discussed below.

Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer or mobile device. It may contain certain data, including, but not limited to the name of the server that has placed it there, an identifier in the form of a unique number, and an expiration date (some cookies only). Cookies are managed by the web browser on your computer (Internet Explorer, Firefox, Safari, or Google Chrome). You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our website, allowing us to enhance your user experience. Different types of cookies which have different purposes are used on our website.

Essential Cookies. These cookies are essential to allow you to browse our website and use its functions. 

Performance Cookies. These cookies collect information on the use of our website, such as which pages are consulted most often. This information enables us to optimize our website and simplify browsing. Performance cookies also enable our affiliates and partners to find out whether you have accessed one of our websites from their site. These cookies do not collect any information which could be used to identify you. All the information collected is aggregated, and therefore anonymous.

Functionality Cookies. These cookies enable our website to remember the choices you have made when browsing. For example, we can store your geographical location in a cookie so that the website corresponding to your area is shown. We can also remember your preferences, such as the text size, font and other customizable aspects of the website. Functionality cookies may also be able to keep track of the products or videos consulted to avoid repetition. The information collected by these cookies cannot be used to identify you and cannot monitor your browsing activity on sites which do not belong to us.

It is possible that you will come across third-party cookies on some pages of sites that are not under our control.

We also use cookies to implement tracking technology on our website. This allows us to display advertising that is tailored to you on our website which parts of our content interest you the most and which service categories you request. This tracking uses de-identified personal information data. We will not combine this data with your other personal information without your express permission. Some of our contracted vendors and affinity partners are allowed to place cookies on our website. Those companies may also provide you with the option of preventing the use of cookies in the future. Local Storage Cookies. Certain features of our website may use locally stored objects (or Adobe Flash cookies) to collect and store information about your preferences and navigation to, from, and on our website. Local storage cookies are not managed by the same browser settings as are used for browser cookies. 

Web Beacons. Pages of our website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity). 

Pixel Tracking. In addition to using Cookies, our website may employ “pixel tracking,” a common process which may be used in connection with advertisements on other sites. Pixel tracking involves the use of pixel tags that are not visible to the user and consist of a few lines of computer code. Pixel tracking measures the effectiveness of advertisements and compiles aggregate and specific usage statistics. A “pixel tag” is an invisible tag placed on certain pages of websites that is used to track an individual user’s activity. We may access these pixel tags to identify activity and interests that may allow us to better match our products, services, and offers with your interests and needs. For example, if you visit our website from an advertisement on another website, the pixel tag will allow the advertiser to track that its advertisement brought you to the website. If you visit our website, and we link you to another website, we may also be able to determine that you were sent to and/or transacted with a third-party website. This data is collected for use in our marketing and research.

IP Address. Our servers automatically record certain log file information reported from your browser when you access our website. These server logs may include information such as which pages of the website you visited, your internet protocol (“IP”) address, browser type, and other information on how you interact with the website. These log files are generally deleted periodically.

Do Not Track (DNT) Signals. We do not currently employ a process for automatically responding to DNT signals sent by web browsers, mobile devices, or other mechanisms. Per industry standards, third parties may be able to collect information, including personal information, about your online activities over time and across different websites or online services.

Global Privacy Signal. You can use the Global Privacy Control (GPC) through a supported browser to signal your opt-out preferences. You may opt out of the processing of your personal information for purposes of targeted advertising or certain sales of your personal information by broadcasting the GPC signal through a supported browser. If you use the GPC, we will process your request for your browser, but it will not apply outside of that browser to your device. You will need to use the GPC for each browser you use to access our website. If you clear your cookies in your browser after using the GPC, you will need to use the GPC again for us to process your opt-out preferences for that browser.

We may combine information collected through your interactions with our website with other information that you voluntarily provide or that we maintain to support analytics, improve customer engagement, and enhance marketing activities. 

Information We Collect from Third Parties

We may receive personal information from third parties, such as analytics providers, advertising partners, recruiting tools, background-check providers, event or webinar platforms, distributors, and publicly available sources, where permitted by law.

• Employment and Background Information. For job applicants in the United States, to the extent permitted by applicable laws, we may obtain reports from public records of criminal convictions or sex offender registrations. 
• Other Sources. To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from service providers like identity verification services for our fraud prevention and risk assessment efforts. We may receive information about you and your activities on and off our website through partnerships, or about your experiences and interactions from our partner ad networks.

Third-Party Use of Cookies and Other Tracking Technologies

Certain third parties, such as analytics, advertising, embedded-content, and social-media partners, may collect personal information through cookies, pixels, or similar technologies on our website. Depending on the circumstances and applicable law, this may constitute a “sale,” “sharing,” or use of personal information for targeted advertising. To exercise applicable opt-out rights, please use the website’s preference center (preferences), cookie settings, or other methods described in the “Data Rights and Choices (U.S.)” section below.

We do not control these third parties’ tracking technologies or how they may be used. Google. We may use Google services such as Google Analytics (click for link to Google’s website), Google Maps, or Google advertising tools. These providers may collect device, usage, and online activity information in accordance with their own privacy terms. You can learn more about Google’s practices and available controls through Google’s privacy and advertising settings. Where required by law, we will provide required choice mechanisms before using non-essential Google advertising or analytics technologies.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, for one or more of the following purposes:

• To present our website and its content to you and to operate, maintain, and improve the services and their functionality;
• To provide you with information on products or services that you request from us;
• To provide you with the products or services that you have requested;
• To send you emails, newsletters, and other communications about our products, services, company, and other relevant information;
• To enhance and improve our products and services, for example, by performing internal research, analyzing user trends, monitoring aggregate metrics, measuring demographics and interests, and using operational data to improve our internal processes and identify cost-savings opportunities for our customers;
• For internal purposes, such as website and system administration, internal audits and reviews, diagnosing services or technical problems, maintaining security, and personalizing content;
• To contact you regarding our website and to send important notices, such as communications about your account, or changes to our terms, conditions, and policies;
• To notify you of data privacy incidents and/or provide you with legally required information;
• To respond to your questions or other requests;
• To fulfill any other purpose for which you provide and consent to; and/or
• In any other way we may describe at the point of collection.

How We Disclose Your Personal Information

We may disclose your personal information, in whole or in part, to the following categories of recipients:

• Recruiting and background-check providers;
• Event and communications vendors;
• Analytics, advertising, and technology partners;
• Government authorities, regulators, and parties involved in legal process; and
• Parties involved in corporate transactions.

Disclosures to Service Providers. We disclose personal information to vendors, service providers, contractors, and other processors that perform services on our behalf, such as website hosting, cloud storage, analytics, communications, recruiting support, security, payment processing, event administration, and IT support. We require these parties to use personal information only as necessary to provide services to us, unless otherwise permitted by law.

Required Disclosures. Except as otherwise described in this Privacy Policy, we will not disclose your personal information to any third party unless required to do so by law, court order, legal process, or subpoena, including to respond to any government or regulatory request, or if we believe that such action is necessary to: (a) comply with the law, comply with legal process served on us or our affiliates, subsidiaries, contracted vendors, or affinity partners, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) enforce our terms (including for billing and collection purposes); (c) take precautions against liability; (d) investigate and defend ourselves against any third-party claims or allegations; (e) assist government enforcement agencies or to meet national security requirements; (f) to protect the security or integrity of our website, our services, or any software we provide related thereto; or, (g) exercise or protect the rights, property, or personal safety of us, our users or others. 

We will attempt to notify you about these requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon us, our users, our website, or our services. In instances where we comply with legal requests without notice for these reasons, we will attempt to notify that user about the request after the fact if we determine in good faith that we are no longer legally prohibited from doing so and that no risk scenarios described in this paragraph apply.

It is likely that the identity and categories of such third parties will change during the life of your account. We require that our third-party service providers only use your personal information as necessary to provide the requested services to us and each service provider is subject to a set of terms consistent with the applicable portions of this Privacy Policy.

We do not sell personal information for money. However, like many companies, we may use analytics, advertising, and similar technologies that involve disclosure of personal information to third parties and that may be considered a “sale,” “sharing,” or processing for targeted advertising under certain state privacy laws. Where required by law, we provide consumers with the right to opt out of those activities.

Disclosure of De-Identified Personal Information. We may use and disclose deidentified, aggregated, or anonymous information for lawful business purposes, including analytics, research, product improvement, benchmarking, and reporting. We will not attempt to reidentify de-identified information except as permitted by applicable law. 

Corporate Transactions. We may disclose personal information in connection with an actual or prospective merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or other corporate transactions, subject to applicable confidentiality and legal requirements.

Data Transfer/Access Outside of the United States

We are based in the United States and may process or store personal data in the United States and other countries where we or our service providers operate. Transfers of personal information within the Kurita Group (which includes Kurita Water Industries Ltd. and its subsidiaries worldwide, including us) are governed by applicable privacy policies designed to ensure compliance with laws and regulations in the relevant jurisdictions, or by agreements among members of the Kurita Group that contractually require each member to ensure that personal information receives an adequate and consistent level of protection wherever it is transferred within the Kurita Group. When we transfer personal information outside the Kurita Group, including to third-party service providers, we obtain contractual commitments requiring the recipient to protect personal information, such as contractual protections and other approved transfer mechanisms where applicable.

We are committed to ensuring your information is protected and apply safeguards in accordance with applicable law. 

Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, acquisition, destruction, use, modification, or disclosure. These measures may include access controls, encryption where appropriate, use of firewalls, network monitoring, secure development and patching practices, vendor oversight, and incident-response procedures.

No method of transmission over the internet or method of storage is completely secure, and we cannot guarantee absolute security.

Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services, maintain our relationship with you, operate our business, comply with legal obligations, and protect against fraud or misuse. Retention periods vary depending on the nature of the information, the context in which it was collected, and applicable legal or operational requirements. 

Data Rights and Choices (U.S.)

Depending on where you live and the laws that apply, you may have certain statutory data protection rights regarding your personal information. These rights may be subject to exceptions and limitations under applicable law.

You may have the right to:

• be informed of what personal data we hold about you and request access to and/or a copy of it;
• request that we correct personal information that is inaccurate or incomplete;
• request that personal information be removed from our systems (deleted), subject to certain exceptions;
• request a portable copy of certain personal information;
• opt out of certain processing of your personal information, including (where applicable) targeted advertising, and the sale or sharing of personal information (as those terms may be defined by applicable law);
• withdraw your consent at any time where we process personal information based on your consent (this will not affect the lawfulness of processing before you withdrew consent);
• not be discriminated against for exercising your rights (where applicable); and/or
• appeal a decision we make about your request (where applicable under U.S. state law).

Additional disclosures for certain U.S. states:

• Sale/Sharing for targeted advertising: Kurita does not sell personal information or customer data. Kurita does not share personal information for cross-context behavioral advertising (also called targeted advertising) as those terms may be defined under certain U.S. state privacy laws.
• Sensitive personal information: Kurita uses sensitive personal information only for purposes such as providing products and services, credentialing, security, fraud prevention, and compliance with law, as described above, and not to infer characteristics about you for targeted advertising.
• Non-discrimination: Kurita will not discriminate against you for exercising your privacy rights.

Verification Process

Email Verification Method. Upon receiving a data access or deletion request from you we will send an email to you at the email address we have for you on file. The email will ask you to respond to verify you as the consumer making the request. Upon receipt of your verification, we will match your information to that which is in our file. Upon verification of your identity, we will proceed to process your request (subject to the applicable exceptions).

Webform Verification Method. When you submit a request using our webform (available here), we will match the information you submitted with the information we have for you on file. Upon verification of your identity, we will proceed to process your request. We may not be able to comply with your request if: (a) we are unable to verify your identity, (b) if we are unable to match you with information in our database, or (c) if an exception under the law exists exempting us from complying with your request.

Authorized Agents (where applicable)

In some U.S. states, you may designate an authorized agent to submit a request on your behalf. If you use an authorized agent, we may ask for proof that the agent is authorized, and we may also require you to verify your identity directly with us.

Appeals (where applicable)

If we deny your request, you may have the right to appeal our decision. To appeal, please email KAI_LegalReview@Kurita-Water.com with the subject line “Privacy Request Appeal” and include your original request and our response. We will review and respond within the time required by applicable law.
